These Terms of Use (“Terms”) govern access to and use of Nearank’s websites, applications and services (“Services”). By creating an account or using the Services, you agree to these Terms.
1. Accounts and eligibility
You must be at least 18 years old and legally able to enter contracts. You are responsible for keeping your account credentials secure and for all activity under your account.
2. Free trial and subscriptions
- New accounts begin with a 7-day free trial unless otherwise stated.
- After the trial, you must select a paid plan based on the number of locations or accounts you manage.
- Fees are charged in advance and are non-refundable except where required by law.
- You may cancel at any time; service continues until the end of the current billing period.
3. Your content and responsibility
You retain ownership of content you submit or approve for publishing. You are solely responsible for ensuring that published content complies with applicable laws, platform rules and third-party rights. Nearank provides draft suggestions and automation tools, but you decide what goes live.
4. Acceptable use
You may not use Nearank to:
- Post spam, hate speech, harassment, illegal content or infringing material.
- Attempt to bypass platform limits, abuse APIs or interfere with other users.
- Reverse engineer, scrape or probe our systems beyond permitted API access.
5. Third-party platforms
Nearank connects to Instagram, TikTok and Google Business Profile. Your use of those platforms remains governed by their terms and policies. We are not responsible for changes, outages or account restrictions imposed by third parties.
6. Affiliate program
- Affiliates earn a percentage of payments made by referred customers for a fixed period.
- Commissions are calculated on net payments received, excluding refunds and chargebacks.
- Self-referral, fraud or misleading promotion will result in forfeiture of commissions and termination.
7. Termination
We may suspend or terminate your account for violations of these Terms or extended non-payment. You may delete your account at any time from Settings.
8. Disclaimers and liability
The Services are provided “as is” without warranties of any kind. To the fullest extent permitted by law, Nearank’s liability is limited to the amount you paid us in the 12 months preceding the claim.
9. Changes to these Terms
We may update these Terms from time to time. Material changes will be announced by email or in-app notice. Continued use after changes constitutes acceptance.
